Welcome to TravelNova. These Terms & Conditions (“Terms”) govern your access to and use of the TravelNova mobile application, website, and related services (together, the “Platform”). By creating an account, accessing, or using TravelNova, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. About TravelNova

TravelNova is a social travel platform that allows users to share travel experiences, itineraries, opinions, recommendations, photos, and related content. TravelNova is a technology platform only.

TravelNova is not:

• a travel agency

• a tour operator

• a booking agent

• an accommodation provider

• an airline or transport provider

• a guarantor of any trip, service, or destination

• a provider of professional travel, legal, financial, or safety advice

Any travel decisions you make are your own responsibility.

2. Eligibility

You must be at least the minimum age required under applicable law to use the Platform. If you are under the age of majority in your location, you may only use the Platform with the consent of a parent or legal guardian.

By using TravelNova, you confirm that you meet these requirements.

3. User Accounts

To access certain features, you may need to create an account.

You agree to:

• provide accurate and current information

• keep your login details secure

• be responsible for activity under your account

• notify us of unauthorized access or suspected misuse

We may suspend, restrict, or terminate accounts that are false, misleading, inactive, abusive, or in breach of these Terms.

4. User Content

Users may upload, submit, publish, or share content including text, reviews, itineraries, recommendations, comments, photos, and other materials (“User Content”).

You retain ownership of your User Content. However, by posting content on TravelNova, you grant us a worldwide, non-exclusive, royalty-free, transferable license to host, store, reproduce, display, distribute, adapt, promote, and make available that content in connection with operating, improving, and marketing the Platform.

You represent that:

• you own or have the necessary rights to your content

• your content does not infringe any third-party rights

• your content is not unlawful, defamatory, misleading, or harmful

We may remove or restrict User Content at our discretion.

5. Opinions, Accuracy & Reliance on Content

TravelNova contains content created by users. Unless expressly stated otherwise, content on the Platform reflects personal opinions, experiences, preferences, and subjective views of individual users.

TravelNova does not verify, endorse, guarantee, or warrant the accuracy, completeness, safety, legality, quality, reliability, or suitability of any user-generated content.

Not all content will be accurate, current, trustworthy, suitable for your circumstances, or free from error.

You should independently verify important information before relying on it, including but not limited to:

• visa requirements

• safety conditions

• health advice

• weather conditions

• transport schedules

• accommodation details

• pricing

• local laws

• destination risks

Your reliance on any content is entirely at your own risk.

6. Travel Risks & No Liability for Travel Outcomes

Travel involves inherent risks and variables beyond our control, including delays, cancellations, weather events, accidents, illness, crime, political unrest, natural disasters, service failures, border restrictions, and changes in local conditions.

TravelNova is not responsible or liable for any loss, injury, damage, inconvenience, delay, expense, disappointment, or other outcome arising from:

• travel plans made using content found on the Platform

• user recommendations or itineraries

• third-party services or bookings

• destination conditions

• inaccurate or outdated information

• cancelled or delayed transport

• accommodation issues

• safety incidents

• personal injury

• theft or loss of property

• missed connections

• government restrictions or policy changes

You acknowledge that all travel decisions are made solely by you.

7. Third-Party Services, Links, Affiliate Links & Bookings

The Platform may include links, integrations, offers, recommendations, booking tools, advertisements, or references to third-party websites, products, accommodation providers, transport providers, travel services, or other businesses.

Some links on the Platform may be affiliate links. This means TravelNova may earn a commission, referral fee, or other compensation if you click a link, make a booking, or purchase a product or service through that link, at no additional cost to you unless otherwise stated.

Any dealings you have with third parties are solely between you and that third party. Separate terms, conditions, and privacy policies may apply.

TravelNova does not own or control third-party services and is not responsible for:

• third-party pricing

• availability

• bookings

• cancellations

• refunds

• customer service

• representations made by third parties

• third-party products or services

• errors or failures on third-party websites or apps

Where reasonably required, affiliate relationships or commercial arrangements will be disclosed within the Platform.

8. Acceptable Use

You must not use the Platform to:

• break any law

• harass, abuse, threaten, or intimidate others

• post hateful, discriminatory, obscene, or violent content

• post false, deceptive, or misleading information

• impersonate another person or entity

• spam or conduct unauthorized promotions

• upload malware, viruses, or harmful code

• scrape, copy, reverse engineer, or exploit the Platform

• infringe intellectual property rights

• interfere with the security or operation of the Platform

We may take action including content removal, suspension, termination, or legal reporting.

9. Intellectual Property

All rights in the Platform (excluding User Content), including software, branding, logos, designs, features, text, graphics, and compilations, are owned by or licensed to TravelNova and are protected by applicable laws.

You must not copy, reproduce, modify, distribute, sell, or create derivative works from the Platform except as permitted by law or with our written consent.

10. Privacy & Data Handling

We respect user privacy. Our data practices are described in our Privacy Policy.

Unless otherwise stated, user information is not sold to third parties. We use information you provide to operate the Platform, maintain security, improve features, communicate with you, and comply with legal obligations.

We may store data using reputable service providers or cloud infrastructure located in different jurisdictions. We take reasonable steps to protect personal information, but no system can be guaranteed completely secure.

You are responsible for any information you choose to share publicly on your profile or in content you post.

11. Future Features, Advertising & Monetization

TravelNova may introduce or operate commercial features at any time, including:

• affiliate links

• advertisements

• sponsored content

• promoted placements

• premium features

• subscriptions

• paid services

• partnerships

• booking integrations

• commerce features

TravelNova may receive compensation, commissions, referral fees, advertising revenue, or other commercial benefits from these features.

Sponsored, promoted, or paid content will be identified where reasonably required by applicable law.

Your continued use of the Platform after such features are introduced or updated constitutes acceptance of those changes, subject to any rights you have under applicable law.

12. Availability & Changes to the Platform

We may update, modify, suspend, restrict, discontinue, or remove any part of the Platform at any time, with or without notice.

We do not guarantee uninterrupted access, compatibility with all devices, or that the Platform will always be available, secure, or error-free.

13. Disclaimer of Warranties

To the maximum extent permitted by law, the Platform is provided on an “as is” and “as available” basis.

We make no warranties or representations, express or implied, regarding:

• availability

• uptime

• accuracy

• reliability

• fitness for a particular purpose

• security

• non-infringement

• error-free performance

Nothing in these Terms excludes rights that cannot lawfully be excluded under applicable consumer laws.

14. Limitation of Liability

To the maximum extent permitted by law, TravelNova and its owners, directors, employees, contractors, affiliates, and partners are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, data, opportunity, travel costs, bookings, or business interruption arising out of or related to your use of the Platform.

Where liability cannot be excluded, it is limited to the minimum extent permitted by law.

15. Indemnity

You agree to indemnify and hold harmless TravelNova and its owners, officers, employees, contractors, and affiliates from any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• your use of the Platform

• your User Content

• your breach of these Terms

• your violation of any law or third-party rights

16. Suspension & Termination

We may suspend, restrict, or terminate your access to the Platform at any time if we reasonably believe you have breached these Terms, created risk, or where necessary for operational or legal reasons.

You may stop using the Platform at any time.

17. Governing Law

These Terms are governed by the laws of Western Australia and the laws of Australia where applicable, unless otherwise required by mandatory local law.

18. Changes to These Terms

We may amend these Terms from time to time. Updated versions will be made available through the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
